FIFTH DRAFT OF AGREEMENTWe, Regents of those kingdoms united by ancient friendships, related by strong dynastic relations, for the Brotherhood of our people, around and in participation with the Byzantine Empire; Inspired and moved by common projects of growth an wealth for Our Kingdoms and for Our People, we undersign a Common Path for a Common Wealth of Our Nations and Our People.
Therefore we communicate to Our People and to People and Regents of all countries the Establishment of the Imperial Commonwealth, formed by the Byzantine Empire, The Kingdom of Albania, The Kingdom of Bavaria, The Kingdom of Ferrara, The Principality of Kiev, The Kingdom of Poland, The Kingdom of Cyrenaica, The Sultanate of Mamluk, The Ottoman Empire, The Kingdom of Seljuq and that will be open for all to participate.
Hence, we unitedly and firmly dispose that the Imperial Commonwealth will be as follows:
TITULUS I
Art. 1) Societatis natura
1. The alliance among represented people will be named Imperial Commonwealth
2. The purpose of the Commonwealth is the federal union of the countries for their own sake and wealth, built in one supranational organism.
3. Commonwealth is presided by His Majesty the Regent of Konstantinoupolis
4. Commonwealth is ruled by the Regent Assembly.
5. All participants, regents and their citizens, are equals
Art. 2)Societatis consitutio
1. Commonwealth definition is as in Titulus I Art.1) clause 2
2. Commonwealth is represented by the Regend Assembly of all participant kingdoms (from here on named R.A.)
3. R.A. is formed, by:
a)The Regents of the participant kingdoms or by someone who Regent name him, with official letter, representative and have given him the right to vote in his place
b) One Judge, Guard Captain/Constable and one Ambassador from every member of I.C
4. Every Kingdom has one vote only.
5. Right for vote have only the Regents or their representatives .
6. R.A. takes decisions only if all Regents agree or 50%+1 of the Regents agree and the rest are abstent.
7. R.A. votes last 48 hours or 24 hours if the matter is urgent.
8. Every R.A. member can call for a voting concerning every matter or decision that I.C. must take.
Art. 3) Common Hall of Commonwealth and Peers Hall of Commonwealth
1. Common Hall is established, as operative center of Commonwealth.
2. It is made of a Public Room useful to all Commonwealth activities and to whom will interact with it.
3. Peers Hall is established, as Room reserved to R.A. members.
4. This room will be reserved for all R.A. members for them to meet and to discuss about issues.
5. Military Cooperation
Art. 4) Diplomacy
1. All members of I.C. have obligation to be Allies with all the rest members of the I.C.
2. If a third party declares a member of I.C. as Hostile then all the members must declare that party Hostile.
3. Members of I.C. can retain independently Friendly or Ally relations with third parties but always relations with other I.C. members must come first.
4. Members of I.C. can vote for Ambassadors to represent I.C. at third parties with the same rules of Titulis I Art.2) clause 4.
5. In a case that an I.C. member declares a third party Hostile first without the proper discussion in Peers Hall, the members of I.C. have no obligations to that member.
Art. 5) Disputes among the members
1. In a case of internal dispute among two or more members of I.C. the discussion is the only accepted solution
2. If a solution by discussion is not possible then the R.A. (apart from the members that have disputes) interferes and uses the most accepted solution which the members of the dispute must accept
TITULUS II
Art.1) De Mercatura
1. I.C. rules the market of participant kingdoms as defined in this Article, in the following clauses.
2. Commercial relations among Kingdoms is free and follows the market flow, or Commonwealth prescriptions, without musts in buying or selling. The market alteration is, nevertheless, forbidden and it is defined as "mechanism or artifice to modify the natural price of a good, set by market rule or eventual Commonwealth prescription". Punishment is set and ruled by local government.
3. In each member of I.C. there is no additional taxes for residents in other Kingdoms members.
4. Exploiting natural resources of each region is at same conditions for every Commonwealth citizen on its territory. However, it is permitted to all Vassals to forbid this right in case the resource is depleted. Forbidding period cannot last longer than 7 days in any case, breakers of the law will be trialled with local laws. It is, furthermore, if that resource is considered strategical for a kingdom to reserve the exploitation to chosen workers.
5. Each I.C. citizen has in primis to turn to, searching for a commercial partner, others I.C. citizens.
6. Each kingdom has to rule by itself the shops production, as for agriculture, to avoid either overproduction, either underproduction of goods or raw materials
Art. 2) Res Militaribus
1. All soldiers of I.C. members are part of Commonwealth Army
2. C.A. is commanded by R.A. when in peace
3. C.A. is commanded by Commander of C.A. in a case of war
4. C.o.C.A. is selected by R.A., from R.A. members with a simple vote that requires only the 50%+1
5. In a case nobody gathers 50%+1 a second vote follows amongst the two with the most votes.
6. In a case of war Peers of Commonwealth may be used as C.A. headquarters
7. All soldiers of C.A. are obligated to obey orders of C.o.C.A.
Art. 3) De Lege
1. Jurisdiction is federal, meaning that any judge of I.C. member can put in trial any citizen according to the laws, of any I.C. member, he broke
2. Judges of I.C. members form Supreme Court Group were new laws are discussed and proposals are made to R.A. concerning federal laws
Art. 4) Res Sacrae
1. I.C. has religious tolerance to all religions and to atheism
2. Destroying a religious building without the permission of the Regent that hosts it in his lands, is federal crime and is punished. Punishment is set and ruled by local government.
3. In a case of religious conflicts amongst the members Titulus I Art. 5) is followed.
Art. 5)
1. All I.C. citizens are treated as Commonwealth citizens.
2. All I.C. citizens are treated like they have citizenship in every participant Kingdom of this treaty.
3. No discrimination is accepted among the citizens of I.C.
TITULUS III
Art. 1) De Fine Facere
1. If I.C. member wants to leave I.C. must inform with formal letter at Peers of Commonwealth thirty (30) days before it’s withdrawal from treaty.
2. All the relations of the member that withdrew from the treaty with the rest members of I.C. subject to Titulus I Art. 4)
Art. 2) De Exlcudere
1. If an I.C. member does not comply to all articles of that Treaty will be warned by R.A.
2. After the third warning of R.A. starts a vote in R.A. for exclusion of that member from that treaty, excluding the member that the vote is for.
3. The vote continues until the member is excluded or is complied to the treaty.
4. After the first vote to exclude member from I.C. the next votes need only 50%+1 to be in effect.
Art. 3) De Foederis
1. Any changes in the current treaty passes from R.A. and must have all the regent approval.
2. If a third party is interested to be part of I.C., R.A. discusses it for three days, then votes for the Acceptance or the Refusal of the third party and it must have all the regents approval.
3. This treaty will be valid in all Kingdoms singing it the day they signed it.
Composed, in its fifth edition, and signed in the Blakernai Imperial Palace in Konstantinoupolis, on XIth day of the XIInd month of the MCCCXIIIth Year of Grace.For the Byzantine Empire
